This Agreement Constitutes an Order for Wedding Portrait and Cinematic Services, Including the Taking of Wedding Day Pictures and Filming of Wedding Day Footage as Agreed to by Both Parties: Cedar Film Co and Client. Unless Otherwise Specified, It Is Understood That Any and All Rights to Proofs, Final or Sample Prints, Thereof Shall Remain Property of Joshua Tyler Productions and May Be Used for Advertising, Marketing, Display or Any Other Purpose Thought Proper by Cedar Film Co.
If the Photographer/Cinematographer, Cedar Film Co, Cannot Perform This Agreement in Whole or in Part Due to an Emergency, Pandemic, Casualty, Injury, Acts of God or Nature or Terror or Other Cause Beyond the Control of the Parties Due to Further Liability with Respect to This Agreement No Liability Will Be Held to Cedar Film Co. This Limitation on Liability Shall Also Apply in the Event That Photographic Materials Are Damaged in Processing, Lost Through Camera Malfunction, Lost in Mail, or Otherwise Lost or Damaged with Fault on the Part of the Photographer/Videographer. Client(s) Agree That an Entire Wedding Cannot Be Replicated, Reenacted or Repeated for the Purpose of a Re-Shoot and Limits Cedar Film Co Liability to the Amount Paid Under This Contract.
In the Event of an Extenuating Circumstance on Cedar Film Co’s Part, Cedar Film Co Will Find and Hire an Alternative Photographer/Cinematographer or Reimburse the Full Amount Paid to the Customer, Including the Retainer Fee. Cedar Film Co Will Not Be Held Liable for Services Not Rendered. To Receive a Full Refund, Joshua Tyler Productions Must Be Notified 60 Days Before the Wedding Day; If Not, Joshua Tyler Productions Will Get to Keep Everything That Has Been Paid for Up Until That Point. Cedar Film Co Also Has 90 Days to Refund the Money Upon Receiving Notification That the Wedding Was Cancelled.
On Signing of This Agreement by Both Parties Hereto, Cedar Film Co Will Reserve the Time Agreed Upon and Will Not Make Another Reservation for the Specific Time Frame.
A 50% Retainer Is Needed to Secure Your Date and Time of Wedding. The 50% Retainer Is Non-Refundable in the Event of Cancellation or Date Change. The 50% Retainer Covers the Time Spent Coordinating Pre-Wedding Arrangements and Securing a Date Which Would Otherwise Be Unavailable to Other Clients. The Retainer Will Be Applied Towards the Total Amount Billed. The Remaining Balance Is Due 30 Days Prior to the Wedding Date.
The Amount Agreed Upon Covers the Photographer/Cinematographer’s Time, Talent, Proofing and Editing. It Also Cannot Be Changed or Altered by Any Means.
The Contract Is Based on Cedar Film Co’s Current Pricing at the Time of Booking. The Price List Is Adjusted Periodically and Future Orders Shall Be Charged at the Prices in Effect at the Time When the Order Is Placed. (Applies to All Product Orders, Packages and Collections.)
It Is Understood That Cedar Film Co Is the Exclusive Official Photographer/Cinematographer Retained to Perform the Photographic/Cinematographic Services Requested on This Contract. No Other Photographer/Cinematographer Is Allowed to Take Photos/Film Footage at the Wedding or Engagement Session (If Applicable) Unless Express Permission Is Given by Cedar Film Co. or Otherwise Client Has Hired Secondary Photographer/Cinematographer’s to Work with Cedar Film Co.
Cedar Film Co Will Choose the Best Images/Clips from the Engagement Session (If Applicable) and the Wedding Day. Cedar Film Co Does Not Show Un-Edited Images/Footage, Nor Involve the Clients in the Process of Choosing Which Images Will Be Chosen for the Final Gallery/Film(s). Joshua Tyler Productions Spends a Great Deal of Time Going Through Each Image/Clip Individually. Please Rest Assured That Joshua Tyler Will Only Show You the Best of the Best and Any Images/Footage That Is Unappealing (I.e. Eyes Closed, Unflattering Facial Expressions and Most Definitely, Any Images/Footage That Do Not Meet Joshua Tyler’s High Professional Standards Will Get Deleted Immediately).
If and When Photography Is Applicable, the Wedding Images Will Be Displayed in an Online Gallery Within 3-4 Months Weeks of Your Wedding Day. The Online Gallery Will Be Available for 1 Year. If You Wish to Order Prints Then Ordering Should Be Completed in That Time Frame, ($35.00 Will Be Charged for Each Additional Month You Request the Gallery to Remain Available).
The Wedding Film(s) Will Be Displayed Via Facebook, Instagram, Vimeo and Delivered Via Digital Download. If Your Package Includes HD DVDs, They Will Be Mailed Within 3-6 Months of the Wedding.
Please Allow Up to 3-5 Months for Delivery of Photos or Videos.
The Photographer/Cinematographer and Her Secondary Shooters (If Applicable) Will Be Allowed One 20 Minute Break at Their Own Discretion and Bathroom Breaks When Necessary. Each Photographer/Cinematographer Will Be Provided a Full Guest Meal for Weddings Lasting Longer Than 5 Hours. If No Meal Is Provided the Photographer/Cinematographer’s Reserve the Right to Go Off-Site for a Meal for 60 Minutes. It Is Highly Recommended That the Photographer/Cinematographer’s Are Allowed a Meal Directly After Bridal Party to Ensure They Are Finished Eating by the Time the Next Activity Is Scheduled.
An Itinerary Must Be Provided to the Photographer/Cinematographer Before the Wedding or a Timeline Should Be Discussed and Created Between the Client and Cedar Film Co Personnel.
There Will Be a Travel Fee of Up to 0.58¢ per Mile, to and from Client’s Wedding Location. If the Wedding Is Located 2.5 Hours or More Away from Lebanon, TN Then Hotel Accommodations Must Be Booked and Paid for by the Client for Cedar Film Co or the Going Rate for a Hotel Room in the Area Will Be Added to Package Total.
Important Notice Regarding Copyright: It Is Illegal to Copy or Reproduce the Clients Photographs/Film(s) Elsewhere Without Cedar Film Co’s Permission, and Violators of This Federal Law Will Be Subject to Its Civil and Criminal Penalties. All Photographs/Film(s), Both on Cedar Film Co’s Website, Blog or Facebook Page, Including All Potential Proofs and Purchased Prints, Are Copyrighted, Reproduction of Any Image/Film(s) by Any Means, Including Copying, Re-Printing, Screen Captures, and Other Means of Print Reproduction Are Strictly Prohibited and Are a Violation of Copyright Law. Additionally, It Is Illegal to Post Any of Cedar Film Co’s Work on the Internet, Blogs, and Social Networking Sites, Without the Express Permission of the Photographer/Videographer.
Cedar Film Co Gives Client Permission to Post Their Wedding Images and Film(s) Onto Their Social Media Platforms (I.e. Facebook, Instagram, Twitter, Etc.) Online Blogs, Etc. as Long as Proper Credit to "Cedar Film Co" Is Given.
In an Event Where the Client Purchases Raw Footage, It Is to Be Understood That This Is for Client Use Only. No Distribution of Raw Footage to Other Photographers/Videographers/Editors Is Allowed. It Is Copyrighted Material and Must Stay at the Hands of the Client and Cedar Film Co.
Contract Agreement
I/We have read and fully understand the terms of this booking and accept that this contract
becomes effective immediately. We understand that the retainer fee is non-refundable.
I/We understand the remainder of the package cost for Videography is to be paid in full within
30 days of the wedding date.
I/We understand the retainer fee is 50% of the total package cost and due immediately to hold
the date. The date will not be held until the retainer is paid in full. By filling out the form and submitting, I/We agree to the terms and conditions stated above.
